In his judgment on Wednesday, April 12, Justice James Omotosho stopped the Independent National Electoral Commission (INEC) from accepting and using the delegate lists.
According to the court, the delegate list produced in such congresses is unlawful for the party to select its governorship flagbearer in the forthcoming election.
The court held that the 2 congresses were not conducted in accordance with the constitution of the APC as well as the Electoral Act 2022.
Justice Omotosho said that there was no evidence presented before the court that the APC had any valid ward and local government congresses.
Aside from Okpanachi in suit number FHC/ABJ/CS/329/2023, other applicants are Mustapha Ibrahim Idoko, Abu Steven Okpanachi Onechiojo, Yahaya Saidu Nuhu, Aku Umar Goodman, and Omaonu Clement Arome.
The defendants in the applications are the Independent National Electoral Commission (INEC) and the APC.
Earlier reported that the senator representing Kogi West, Smart Adeyemi, has told losers in the 2023 election to try again in the 2027 election.
Adeyemi posited Bola Tinubu, the president-elect, emerged as the winner of the presidential election because he and his vice-presidential candidate, Kashim Shettima, were the most popular candidates.
